1. Introduction

These Terms of Use govern your use of Warere Beach, Zanzibar’s services, including hotel bookings, restaurant and bar services, tours and events.

As a visitor to or user of our services you warrant that you will read our Terms of Use carefully. If you do not agree with any of the provisions set out in these documents, you should not use our services. By accessing or using our website and/or services, you represent and warrant that you have read and understood the Terms of Use, Privacy Policy, will abide by them, and that you are 18 years of age or more. By continuing to use our services you represent and warrant that you have accepted our Terms of Use.

2. Our services

Warere Beach, Zanzibar offers individuals and companies hotel accommodation, restaurant and bar services, as well as event services and tours.

You are solely responsible for the accuracy of the data and personal information that you provide while using our services. Any registration information that you submit to Warere Beach, Zanzibar is true, accurate, and complete, and you agree to keep it that way at all times. 

3. Booking

When making a reservation for a hotel room or other service, you and Warere Beach, Zanzibar will agree on the applicable terms. The terms will be evident through these Terms of Use as well as through your booking confirmation. 

If you choose to book a room through a third party OTA the terms and conditions of the OTA reservation will hold.

If you choose to book a hotel room through our website, your reservation will be managed through a third-party service solution, provided by Cloudbeds and their booking engine Cloudbeds. In order to complete your booking, you must accept the general terms of use of Cloudbeds and, if needed, their specific terms for your booking.

Your reservation will become binding once it has been confirmed by Warere Beach, Zanzibar. The confirmation of your reservation, as well as your unique confirmation number, will generally be provided through email. 

You must be aged 18 years or over to make a booking with us and you must be aged 18 years or over to stay alone in one of our hotel rooms. If a guest arrives at the hotel and is under 18 years of age the guest will not be permitted to stay alone. If a person who is over 18 years of age (“adult”) shares the room with a person under 18 years of age (“minor”), the adult assumes complete liability for the minor’s use of the hotel room and our services in general. 3.6 CANCELLATION POLICY:

Please note that cancellations without penalty (if made outside the time periods outlined below) will only be accepted and valid, when acknowledged via email.

Full payment is due 30 days before arrival. This may be by card or bank transfer.

If between 30 and 15 days before the day of arrival, a reservation is cancelled or the number of nights and/or rooms reduced, then 50% of the total price will be charged.

If between 15 and the day of arrival, a reservation is cancelled or the number of nights and/or rooms reduced, then 100% of the total price will be charged.

4. Payment

When making a reservation through our website, over the phone or on-site at our hotel, you may pay with either debit or credit cards. Warere Beach, Zanzibar does not store any credit card numbers. Payment on invoice is only permissible for company clients, either through a specific agreement or with Warere Beach, Zanzibar express consent, to which there is no entitlement.

Warere Beach, Zanzibar accepts most major debit/credit cards, including Visa, American Express, MasterCard. Your credit card details will never be sent in an email or transmitted by any means other than SSL

Any credit cards submitted online are NOT stored or processed by this website; they are transmitted to Warere Beach, Zanzibar for secure handling and processing per Tanzania finance laws.

Rates are in USD. Any exchange rate differences are not Warere Beach, Zanzibar’s responsibility.

Warere Beach, Zanzibar will apply an extra charge of 3% for card payments. Your bank may however apply additional charges depending on your type of debit/credit card. There may be exchange rate differences applicable. In the event that no payment has been received within 30 days of arrival, Warere Beach, Zanzibar may automatically cancel your reservation.

5. Service limitations and modifications

Warere Beach, Zanzibar will make reasonable efforts to keep our services operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. Warere Beach, Zanzibar reserves the right at any time and for any reason to suspend, discontinue, terminate or cease providing access to the premises or services temporarily or permanently. In the case of any temporary or permanent suspension, discontinuation, termination or cessation of access, Warere Beach, Zanzibar shall use its reasonable endeavours to notify the person(s) of such decision in advance. Any such decision will be made at Warere Beach, Zanzibar discretion.

You hereby agree that Warere Beach, Zanzibar and its subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers, partners and shareholders shall not be liable to you or to any third party for any changes or modifications to our our services that Warere Beach, Zanzibar may wish to make from time to time, or for any decision to suspend, discontinue or terminate the the services or any part or parts thereof, or your possibility to use or access the same from or within any territory or territories.

Warere Beach, Zanzibar may change the features of any type of services, may withdraw or, or introduce new features, products or types of account at any time and for any reason, and may change the prices charged for any of its services from time to time.

6. Data Protection and Privacy

All personal data that you provide to us in connection with your use of the website and our services is collected, stored, used and disclosed by Warere Beach, Zanzibar in accordance with our Privacy Policy.

7. User guidelines

While staying at Warere Beach, Zanzibar, you agree to not engage in any activity that:

• is illegal, or intended to promote or commit an illegal act of any kind, including but not limited to violations of intellectual property rights, privacy rights, or proprietary rights of Warere Beach, Zanzibar or a third party
• is offensive, abusive, defamatory, pornographic, threatening, or obscene
• impersonates or misrepresents your affiliation with another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading
• purposely includes personal data of third parties or is intended to solicit such personal data
• interferes with or in any way disrupts our services, tampers with, breaches, or attempts to probe, scan, or test for vulnerabilities in the services or Warere Beach, Zanzibar computer systems, network, usage rules, or any of Warere Beach, Zanzibar security components, authentication measures or any other protection measures applicable to the services; or

8.1 By using our website, you may be provided with access to third party websites, databases, networks, servers, information, software, programs, systems, directories, applications, products or services.

8.2 Warere Beach, Zanzibar does not have or maintain any control over nor does it take any responsibility for the External Services and is not and cannot be responsible for their content, operation or use. By linking or otherwise providing access to any External Services, Warere Beach, Zanzibar does not give any representation, warranty or endorsement, express or implied, with respect to the legality, accuracy, quality or authenticity of content, information or services provided by such External Services.

9. Intellectual property

All content on the website is, unless otherwise stated, owned by Warere Beach, Zanzibar

The use of trademarks, pictures and logos that appear on the site will require the previous written consent of Warere Beach, Zanzibar.

10. Indemnification

Warere Beach, Zanzibar, its successors, assigns, affiliates, agents, directors, officers, employees, partners and shareholders assumes no liability for any and all claims, obligations, damages, losses, expenses, and costs, including reasonable attorneys’ fees, resulting from theft, bodily injury, epidemics, negligence or wrongful action of employees.

Any potential dispute shall be settled in accordance with Zanzibar Laws.
